By accessing or using Kallax.io, you agree to these terms. As a privately operated and independent software project, these rules exist to ensure a safe, sustainable, and respectful environment for all boardgaming enthusiasts. See also Privacy Policy.

1. Eligibility & Age Requirement

By creating an account, you represent and warrant that you are at least 18 years of age. Because this service facilitates interpersonal communication and physical event management, minors are expressly prohibited from utilizing the service for safety and legal compliance. This application is specifically intended for an adult audience.

2. Content & Intellectual Property

You retain full ownership of the content you upload (avatars, photos, and descriptions). However, by posting, you grant Kallax.io a non-exclusive, worldwide, royalty-free license to display and host your content as required to provide our services. You represent that you possess the necessary legal rights for all content you upload. Mature content is prohibited.

3. Data & Conduct

Data Management: Guest accounts may be terminated and all associated data deleted following 90 days of inactivity. Hobbyist and Enthusiast tiers are exempt from this automated deletion. Kallax.io assumes no responsibility for any loss of data.

Prohibited Behavior: We reserve the right to terminate accounts for harassment, spamming, or unauthorized automated behavior. You may not use any 'robot,' 'spider,' or other automatic device, or manual process to monitor or copy our web pages or the content contained herein without our prior expressed written permission.

Content Removal: We reserve the right to remove any content that we deem, in our sole discretion, to be unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.”

4. Commercial & Business Use

Commercial use of our service is permitted and encouraged, included the use of Enthusiast tier features at no cost.

Our service operates on an honor system. We understand that starting a small business is a high-risk, low-margin journey, and we believe that local shops, cafes, and event organizers are the heart of the board gaming community. Feel free to use the service at no cost for as long as you need to. If and when your business reaches a point where you can comfortably support the project, we would appreciate you joining a paid tier. Until then, focus on your community.

Fair usage: If your commercial use incurs significant infrastructure costs, we will contact you. In such cases, we will provide a 30-day notice period to discuss a custom arrangement or adjust usage before any service changes occur.

No Service Level Agreement (SLA): While we strive for maximum reliability, please note that Kallax.io is a hobbyist-led project. As detailed in Sections 6 and 7, we provide the service on an "as-is" basis and do not guarantee specific uptime or uninterrupted access, regardless of your subscription tier or payment status.

5. Real-World Events & Interaction

Kallax.io serves solely as an organizational tool and does not host, supervise, or vet the events listed. However, we maintain a zero-tolerance policy for illegal or harmful behavior. We reserve the right to ban users reported for violating community safety standards.

Personal Responsibility: By using this platform to organize or attend events, you represent and warrant that you will act in good faith and agree not to cause physical, emotional, or financial harm to any other user.

Assumption of Risk: By participating in any physical meetup, you do so at your own risk. Organizers and attendees are solely responsible for their own safety and conduct.

Indemnification: You agree that Kallax.io and its creator shall not be held liable for any injury, loss, or damage resulting from offline interactions. You agree to indemnify and hold us harmless from any claims arising from your use of the platform or your conduct during events.

6. Service Limitations & Payments

"As-Is" Basis: We provide no guarantees regarding the accuracy of board game data or the permanent preservation of information.

Payments: Premium transactions are processed via Stripe and are subject to their terms.

Refund Policy: As a digital service providing immediate access to premium features, payments are generally non-refundable. However, we honor mandatory refund periods and consumer rights required by the local laws of your jurisdiction (including the EU Right of Withdrawal and applicable international consumer protection statutes).

7. Continuity & Amendments

While we have no intention to do so, Kallax.io reserves the right to discontinue or modify any part of the service at any time. As a hobbyist-led project, we provide no guarantee of the service's long-term availability or the continued maintenance of its features.

Changes to Terms: We may update these terms from time to time to reflect changes in the law or our service. By continuing to use Kallax.io after such changes are posted, you agree to be bound by the updated terms. If you have a paid subscription, we will make reasonable efforts to notify you of any major changes that would affect your account status or billing.

8. Governing Law

These terms are governed by and construed in accordance with the laws of Kingdom of Spain. Any disputes shall be subject to the exclusive jurisdiction of the Spanish courts.

Pursuant to Art. 14 of Regulation (EU) No. 524/2013, the European Commission provides a platform for Online Dispute Resolution (ODR), which can be accessed at https://ec.europa.eu/consumers/odr.
